Il nodo sotteso alla revisione costituzionale in materia di giustizia non è la separazione delle carriere, bensì l’indipendenza della magistratura. Il fine è un giudice che invece di garantire la sicurezza dal potere, limitandolo, assicuri la sicurezza del potere?
Muovendo da questa considerazione il contributo riflette sulle criticità che, sin dall’iter di approvazione, connotano la revisione costituzionale in materia di giustizia. Fil rouge e parametro sono i “fondamentali” in tema di potere giudiziario, ovvero la limitazione del potere e la garanzia dei diritti, che restituiscono il senso della magistratura come elemento della democrazia costituzionale, rendendo altresì evidente la necessità di ragionare contestualizzando la riforma nel momento storico esistente.

The Judiciary as a Countervailing Power: A Critical Analysis of Constitutional Amendment Concerning the Organisation of the Judiciary
The fundamental issue underlying the constitutional reform in the field of justice is not the separation of judicial careers, but the independence of the judiciary. The question, therefore, is whether the reform is intended to produce a judiciary that, rather than fulfilling its counter-majoritarian function by limiting public power, is instead called upon to secure and stabilize that power. Proceeding from this premise, the contribution examines the critical aspects that have characterized the constitutional reform in the field of justice since its very inception and approval process. The guiding thread and analytical benchmark are the “fundamentals” of judicial power – namely, the limitation of power and the protection of rights – which restore the understanding of the judiciary as a constitutive element of constitutional democracy and, at the same time, make evident the need to assess the reform within its specific historical and political context.
