Lo scopo del presente lavoro è quello di analizzare gli sviluppi più recenti della forma di governo britannica, muovendo in primo luogo dalla ricostruzione teorica alla quale finora la dottrina ha fatto prevalentemente riferimento per la descrizione del sistema istituzionale britannico: il c.d. Westminster model.
In particolare il contributo si articola in tre parti: la prima in cui tenteremo di delineare i tratti peculiari del citato modello Westminster cercando di dar conto delle novità e delle recenti tendenze nel rapporto tra esecutivo e Parlamento, approfondendo in particolare il regime della responsabilità ministeriale collegiale, ovvero i meccanismi di effettivo funzionamento del rapporto fiduciario tra Camera bassa e Governo. La seconda parte del contributo si soffermerà invece sul ruolo del Premier, la figura intorno al quale si articola e si esplica l’intera forma di governo.
Nella terza e ultima parte, infine, prendendo spunto dalle evoluzioni e dai fenomeni politico istituzionali più recenti, dopo aver richiamato le principali ricostruzioni dottrinali in merito, tenteremo di trarre alcune conclusioni in merito alla classificazione del sistema di Governo britannico, cercando di evidenziare le prospettive evolutive del modello Westminster, non limitando il campo di indagine esclusivamente all’interno dei rigidi confini del rapporto Parlamento-Governo.
The aim of this work is to analyze the most recent developments in the British form of government, starting primarily with the theoretical reconstruction to which the constitutional doctrine has predominantly referred for the description of the British institutional system: the “Westminster model”.
In particular, the paper is divided into three parts: the first, in which we outline the particular features of the “Westminster model”, trying to describe the innovations and recent trends in the relationship between Government and Parliament, analyzing in particular the convention of collective ministerial responsibility, or the effective mode of operation of the confidence rule between the House of Commons and the Government.
The second part of the paper focuses on the role of the Premier, the figure around which the whole form of government takes shape.
Finally, in the last part of the paper, after having recalled the main theoretical reconstructions on the matter, we take into consideration the most recent legislative developments and political institutional processes and we draw some conclusions regarding the classification of the British government system, trying to highlight the evolutions of the “Westminster model”.
