L’interesse alle e delle generazioni future è stato un tema, sino ad ora, tenuamente scandagliato dalla letteratura giuridica. A differenza di quanto accaduto per altre discipline – tra cui è possibile ricomprendere, certamente, la filosofia –, solo di recente la dottrina giuspubblicistica italiana si è propriamente interessata delle ripercussioni di tale profilo, nonostante, come si avrà modo di apprezzare, oggi più che mai costituisca un ramo d’indagine dal quale non si può più prescindere nella conduzione della ricerca scientifica. La riforma degli articoli 9 e 41 della Costituzione, invero, costituisce solo il punto di partenza, lo spunto per analizzare – nei suoi tratti essenziali – un fenomeno molto più ampio e complesso, che trascende i singoli ambiti e che va, per l’appunto, oltre la richiamata opera di revisione costituzionale.

The Interest of Future Generations beyond the Reform of articles 9 and 41 of the Constitution
The interest in and of future generations has until now been a subject tenuously plumbed in legal literature. Unlike what has happened with other disciplines - among which one can certainly include philosophy -, it is only recently that Italian legal doctrine has taken a proper interest in the repercussions of this profile, despite the fact that, as one will have the opportunity to appreciate, today more than ever it constitutes a branch of investigation from which one can no longer disregard the conduct of scientific research. The reform of Articles 9 and 41 of the Constitution, in fact, constitutes only the starting point, the cue to analyse - in its essential features - a much broader and more complex phenomenon, which transcends the individual spheres and which goes, precisely, beyond the aforementioned work of constitutional revision.
