La natura anche giurisdizionale delle sentenze della Corte costituzionale impone una riflessione in ordine alla azionabilità di rimedi per la loro ottemperanza, specie con riferimento alle sentenze additive ed ai loro effetti nei confronti della pubblica amministrazione.
Il presente studio esamina la possibilità di utilizzare, per ottenere l’esecuzione delle sentenze della Corte, l’istituto dell’ottemperanza del giudicato previsto dall’art. 112 del Codice del processo amministrativo.
The jurisdictional nature of the Constitutional Court’s decisions requires seasonable remarks on the retrieval that can be actuated for their compliance, especially with reference to the so called additive judgements and to their effects for the Public Administration.
This essay examines the possibility to comply with the sentence, as established in article 112 of the Administrative Trial Code, in order to give execution to the judgements of the Constitutional Court.
