Nella concreta determinazione del contenuto della Costituzione incidono molti fattori, positivi e negativi, che il saggio mette in luce. Per poter sopravvivere di fronte ai cambiamenti storici – al di là del difficile ricorso al procedimento aggravato di revisione costituzionale – una Costituzione si può, e si deve, “aggiornare” solo attraverso una sofisticata interpretazione evolutiva soft ed hard, nella quale v’è spazio per il riconoscimento delle istanze di una stabile coscienza sociale, ma non per una volubile opinione pubblica. Una corretta ermeneutica giuridica esclude, invece, il c.d. diritto libero (freies Recht).

Constitutional Interpretation and Social Conscience
The concrete determination of the content of the Constitution is influenced by many factors, both positive and negative, which this essay highlights. In order to survive historical changes, beyond the difficult recourse to the special procedure for constitutional amendment, a Constitution can, and indeed must, be “updated” only through a sophisticated form of evolutionary interpretation, both soft and hard. Such interpretation allows for the recognition of the demands of a stable social conscience, but not of a volatile public opinion. A correct legal hermeneutic, however, excludes the so-called free law doctrine (freies Recht).
