Il lavoro si sofferma, preliminarmente, sulla trasformazione della specialità regionale, che, in seguito alle riforme costituzionali del 2001, tende ad avvicinarsi all’autonomia ordinaria. Uno dei veicoli del fenomeno è costituito dalle “leggi statutarie”, abilitate a modificare gli statuti speciali (che vengono conseguentemente, in parte, decostituzionalizzati). Nella Regione Valle d’Aostta e nella Provincia autonoma di Bolzano, tali fonti del diritto hanno mantenuto il sistema parlamentare, sia pure irrobustito dalla sfiducia costruttiva. Tale soluzione, in netta controtendenza rispetto a quelle adottate da tutte le altre Regioni italiane (e dalla Provincia autonoma di Trento), ha l’effetto di risparmiare all’Assemblea legislativa il depotenziamento che essa ha subito nelle altre realtà regionali. Essa è riconducibile alla forte identità culturale della comunità valdostana e di quella bolzanine, entrambe alloglotte, e nella centralità di partiti locali fortemente identitari.

Transformations of Regions enjoying Special Autonomy Status, "Statutory Laws" and Form of Government
The paper first dwells on the transformation of the regional specialty which, following the constitutional reforms of 2001, tends to approach ordinary autonomy. An important means of this rapprochement consists of the "statutory laws", empowered to modify the special statutes (which are consequently, in part, deconstitutionalized). In the Valle d'Aosta Region and in the Autonomous Province of Bolzano, these sources of law have maintained the parliamentary system, albeit strengthened by constructive distrust. This solution, in stark contrast to those adopted by all the other Italian Regions (and by the Autonomous Province of Trento), saves the legislative assembly from the weakening it has suffered in the other Regions. It can be traced back to the strong cultural identity of the Valle d'Aosta and Bolzano communities, both with mother tongues other than Italian, and to the centrality of strongly identitarian local parties.
