Il contributo ha ad oggetto i temi e le prospettive legate alla giustizia climatica in connessione con le complesse questioni legate alla responsabilità intergenerazionale. Introduttivamente, sono descritte le criticità poste dai cambiamenti climatici e il loro impatto sulla posizione delle generazioni future. Di seguito, il contributo è rivolto ad analizzare il quadro delle fonti della c.d. obbligazione climatica e i profili essenziali legati al climate change litigation. Le conclusioni sono dedicate alla revisione dell’art. 9 della Costituzione italiana e alla possibilità di includere per via interpretativa, entro lo spettro di operatività del terzo comma della norma, anche la tutela dell’equilibrio climatico.

Climate Justice and Intergenerational Responsibility
The contribution deals with the themes and perspectives related to climate justice in connection with the complex issues related to intergenerational responsibility. The introduction describes the critical issues posed by climate change and their impact on future generations. The contribution is then aimed at analyzing the sources of the so-called climate obligation and the essential profiles related to climate change litigation. The conclusions are focused on the revision of art. 9 of the Italian Constitution and at the possibility of including by means of interpretation, within the scope of the third paragraph of art. 9, climate protection as well.
