La legge italiana sulle cure palliative, la n. 38 del 2010, ha compiuto dieci anni. Il contributo illustra la filosofia delle cure palliative introdotta dalla fondatrice dell’hospice movement, Cecily Saunders, e la sua progressiva realizzazione nell’ordinamento italiano. Le cure palliative, tanto nell’idea che le sostiene quanto nella loro pratica realizzazione, avvenuta in singolare rispondenza al principio di sussidiarietà orizzontale, costituiscono un’esemplare attuazione del principio personalista accolto dalla Costituzione repubblicana.
The Italian statute law on palliative care – law no. 38 of 2010 – is already ten years old. Starting from the analysis of the ideas of the founder of the hospice movement, Cecily Saunders, the essay shows that the philosophy and the practice of palliative care in Italy meet the principle of horizontal subsidiarity, on one hand, and, on the other hand, the personalistic principle, which is the heart and the very foundation of the 1948 Italian Constitution.
