Il contributo propone l’intervento pronunciato in occasione della presentazione del IV volume de I Tematici dell’Enciclopedia del diritto, su “Potere e Costituzione”. Dalle “voci” dell’opera emerge che il rapporto tra potere e costituzione si può analizzare in ogni piega della società e dell’ordinamento giuridico. Al costituzionalismo limitativo è succeduto un costituzionalismo attributivo. Oggi, però, si assiste ad una progressiva marginalizzazione del Parlamento. Ogni stagione contiene contemporaneamente il vecchio e il nuovo e può quindi qualificarsi di transizione. Ciò è particolarmente vero in presenza di una Costituzione fortemente progettuale, che si proietta perennemente in avanti, alimentando la politica con la sua spinta innovativa, nell’ambito di un patrimonio condiviso di valori. Il recupero dello spessore ideale e della capacità progettuale dei partiti è premessa indispensabile per una rinnovata centralità del Parlamento.

Power and Constitution
The contribution proposes the speech delivered on the occasion of the presentation of the IV volume of The Thematic of the Encyclopaedia of Law, on "Power and Constitution". From the "voices" of the work it emerges that the relationship between power and the constitution can be analyzed in every corner of society and the legal system. An attributive constitutionalism has succeeded the restrictive constitutionalism. Today, however, we are witnessing a progressive marginalization of Parliament. Each season contains the old and the new at the same time and can therefore qualify as transitional. This is particularly true in the presence of a strongly planned Constitution, which is perpetually projected forward, fueling politics with its innovative thrust, within the context of a shared heritage of values. The recovery of the ideal thickness and planning capacity of the parties is an indispensable premise for a renewed centrality of Parliament.
