Nel contributo si analizza dal punto di vista costituzionale la distribuzione delle competenze tra Stato e Regioni in relazione alla materia “ambiente”. In particolare, è analizzata l’evoluzione del quadro costituzionale delle competenze, a partire dal cosiddetto “primo regionalismo” sino alla riforma costituzionale del 2001. Si esamina in particolare il ruolo avuto dalla Corte costituzionale nel delineare l’articolazione delle competenze tra Stato e Regioni. Infine, si verifica l’impatto delle recenti modifiche costituzionali del 2022, che hanno ancor più accentuato il rilievo costituzionale della tutela dell’ambiente.

Environment and Constitutional articulation of attributions between State and Regions
The contribution analyzes from the constitutional point of view the distribution of attributions between the State and Regions in relation to the subject "environment". The constitutional framework of competencies from the so-called "early regionalism" until the constitutional reform of 2001, is addressed as it has evolved. In particular, the role played by the Constitutional Court in outlining the articulation of competencies between the State and Regions, has been very relevant. Finally, the impact of the recent constitutional amendments of 2022, which have even more accentuated the constitutional prominence of environmental protection, is examined.
