Il contributo analizza l’evoluzione/involuzione del sistema sanitario spagnolo in stretta interdipendenza alle prestazioni sanitarie offerte agli immigrati irregolari. A partire dal 2012, in coincidenza con la crisi finanziaria e l’approvazione del Fiscal compact, infatti, il sistema spagnolo regredisce e simultaneamente restringe la tutela sanitaria degli immigrati irregolari. Tali aspetti vengono evidenziati anche nella recente pronuncia del Tribunal Constitutional n. 139/2016. Il contributo considera infine l’apporto fornito dalle Regioni spagnole, le quali, nonostante la riforma in senso restrittivo, in alcuni casi hanno continuato ad offrire agli immigrati irregolari la medesima tutela assicurata precedentemente.
The publication analyzes the evolution/regression of the Spanish’s health system in parallel with the health services offered to illegal immigrants. Indeed, beginning from 2012, to coincide with the financial crisis and the application of the regulations contained in the Fiscal compact, the modification of the health system has quite simultaneously caused the restriction of the protection previously offered to the illegal migrants. These themes are also highlighted having regard to the decision n. 139/2016 ruled by the Tribunal Constitutional. A relevant emphasis is also given to the role of the Spanish Regions which, in some circumstances, have continued to offer to illegal migrants the same health’s protection guaranteed before the reform.
