Il saggio si propone di indagare su quale sia il procedimento da seguire per modificare il contenuto normativo degli Statuti speciali, muovendo dall’analisi del rapporto tra l’art. 138 Cost. e la l. cost. n. 2 del 2001. Una volta individuata la procedura corretta, negli ultimi due paragrafi ci si chiederà quali conseguenze discendano dal suo mancato rispetto e in che modo si possa eventualmente intervenire per modificare/sostituire legittimamente la suddetta procedura.
This essay seeks to explore the procedure for amending the normative content of “special statutes”, moving from the analysis of the relationship between article 138 of the Italian Constitution and Constitutional Law no 2/2001. Upon identifying the correct procedure for making such an amendment, the final two paragraphs address the question of the consequences that follow from not complying with that procedure and how one could possibly intervene to change/replace the above procedure.
