L’Autore si propone di fornire gli elementi essenziali per una prima valutazione delle misure che hanno limitato la libertà garantita dall’art. 41 Cost. durante la fase più acuta dell’emergenza da Covid-19, muovendo da un inquadramento essenziale dello “statuto” costituzionale di questa libertà, per spingersi poi in una mappatura esemplificativa delle limitazioni concretamente imposte ad essa nel periodo dell’emergenza e giungere, infine, a offrire alcuni spunti di riflessione per la verifica del tasso di conformità/difformità di tali limitazioni rispetto al modello costituzionale.
The Author aims to provide the essential elements for a first evaluation of the measures that have limited the freedom guaranteed by art. 41 of the Constitution during the most acute phase of the Covid-19 emergency, starting from an essential framework of the constitutional “statute” of this freedom, to then go into an exemplary mapping of the limitations concretely imposed on it in the period of the emergency and finally to offer some food for thought for the verification of the rate of compliance/discrepancy of these limitations with the constitutional model.
