Al pari di qualunque enunciato, anche quello, di cui all’art. 101, 2° co., Cost., secondo il quale “I giudici sono soggetti soltanto alla legge”, si presta a differenti letture. È intuitivo, però, cogliere in esso l’esistenza di uno status: vale a dire, di una condizione, di fatto prima che di diritto, che individua un perimetro comune, all’interno del quale debbono necessariamente convivere Potere legislativo e Ordine giudiziario.
Il primo (eletto) elabora disposizioni; il secondo (non eletto) estrae norme. Sono le contraddizioni tra le une e le altre – che possono manifestarsi allorché l’Ordine giudiziario prescinde, oltre il ragionevole, dai criteri stabiliti dall’art. 12 delle disposizioni sulla legge in generale – a far lievitare tensioni, destinate ad assumere un rilievo politico.
La risoluzione dei conflitti sta nell’esercizio del self-restraint da parte di entrambi gli attori-contendenti: come ha rivelato il contrasto relativo alla riforma costituzionale recentemente assoggettata a referendum approvativo-oppositivo.

Legislative Power and the Judicial Order Between Statutory Provision and Legal Norm.
Like any normative statement, Article 101(2) of the Italian Constitution, which provides that “judges are subject only to the law”, is open to different interpretations. It is nonetheless intuitive to discern within it the existence of a status, that is, a condition, factual before it is legal, that delineates a common sphere within which the legislative power and the judiciary must necessarily coexist. The former (elected) enacts statutory provisions; the latter (unelected) derives legal norms. It is the contradictions between the two – liable to emerge when the judiciary departs, beyond reasonable limits, from the interpretative criteria set out in Article 12 of the “Disposizioni sulla legge in generale” – that cause tensions to escalate, eventually assuming political significance. The resolution of such conflicts lies in the exercise of self-restraint by both institutional actors, as evidenced by the dispute concerning the constitutional reform recently submitted to a confirmatory-oppositional referendum.
