Questo articolo intende descrivere lo spazio costituzionale come il luogo dell’ordinamento giuridico in cui si instaurano i rapporti strettamente connessi al patto fondamentale che regge la Repubblica. In questo luogo si realizzano diritti, doveri, poteri, strutture, che, alla luce della loro condivisa attitudine a conservare e a promuovere quel patto, riempiono di contenuto la materia costituzionale. Questa interazione sprigiona una energia che determina il confronto tra domanda e offerta di costituzione. L’equilibrio del sistema è raggiunto quando le aspettative di libertà e di potere, coltivate dalle unità di decisione costituzionale, coincidono. Questo equilibrio, oltre a garantire la stabilità del sistema, consente variazioni dinamiche delle due curve di domanda e offerta, entro il perimetro tracciato dai princìpi supremi dell’ordinamento. Questi princìpi traducono in materiale giuridico le fondamentali concezioni ideali che hanno cristallizzato l’intersezione tra domanda e offerta di costituzione intorno a valori universali e identitari.

Constitutional Space: A Theoretical Framework
This paper aims to describe the constitutional space as the place of the legal system in which the relationships strictly connected to the fundamental pact that governs the Republic are established. In this place rights, duties, powers, structures are realized which, in the light of their shared aptitude for preserving and promoting that pact, fill the constitutional matter. This interaction releases an energy that determines the comparison between supply and demand of constitution. The equilibrium of the system is achieved when the expectations of freedom and power, cultivated by the units of constitutional decision, coincide. This balance, in addition to guaranteeing the stability of the system, allows dynamic variations of the two supply and demand curves, within the perimeter traced by the supreme principles of the constitutional system. These principles translate into legal material the fundamental ideal conceptions that have crystallized the intersection between supply and demand of constitution around universal values and identities.
