Dopo una breve introduzione sul modo in cui la giuspubblicistica italiana si è rapportata al concetto di ambiente, l’articolo indaga le potenzialità normative dell’art.9, c.3, Cost., nei confronti del cambiamento climatico. L’approdo cui si giunge è che la nuova disposizione costituzionale rappresenta una base adeguata per considerare come dovere costituzionale il contrasto al cambiamento climatico.

Environment and climate change in the Italian Constitution
After a brief overview of the Italian legal scholars’ approach to the notion of environment, the paper investigates the normative prospects of Article 9.3 of the Constitution in climate change issues. The basic assumption is that the new provision may well support the elaboration of a constitutional duty to counteract the climate change.
