Il presente contributo analizza il disegno di legge costituzionale A.S. 1670-B, recante modifiche allo Statuto speciale per il Trentino-Alto Adige/Südtirol, limitatamente alla modifica della procedura di revisione dello Statuto. L’indagine si focalizza sull’introduzione del principio dell’intesa tra Stato e organi locali (Consiglio regionale e Consigli provinciali) e di una sorta di clausola di “non regresso”, che impedirebbe al legislatore statale di ridurre unilateralmente i “livelli di autonomia già riconosciuti”. Attraverso una breve ricostruzione storico-sistematica, si evidenzia come tale proposta segni un mutamento di paradigma rispetto agli orientamenti dell’Assemblea Costituente, che aveva invece sottolineato la natura non contrattuale degli Statuti, al fine di preservare l’unità giuridica della Repubblica e la sovranità del legislatore costituzionale. L’articolo esamina criticamente le implicazioni della riforma, ravvisando l’emergere di un nuovo limite materiale (implicito) alla revisione costituzionale che rischierebbe di cristallizzare indefinitamente le prerogative regionali e provinciali. Viene infine sostenuto che l’introduzione del principio dell’intesa (così come delineato dal d.d.l. in esame) non si possa considerare necessaria neppure a fronte degli obblighi internazionali derivanti dal c.d. Accordo De Gasperi-Gruber.

The constitutionalization of the principle of agreement: brief reflections on a proposal to amend the revision procedure of the Special Statute for Trentino-Alto Adige/Südtirol
This paper analyzes constitutional bill A.S. 1670-B, which proposes amendments to the Special Statute for Trentino-Alto Adige/Südtirol, focusing specifically on the modification of the Statute’s revision procedure. The study focuses on the introduction of the principle of agreement between the State and local bodies (the Regional Council and the Provincial Councils) as well as on a form of “non-regression clause”, which would prevent the State legislature from unilaterally reducing the “levels of autonomy already granted”. Through a brief historical and systematic reconstruction, the paper highlights how this proposal marks a paradigm shift from the approach adopted by the Constituent Assembly, which emphasized the non-contractual nature of the Statutes in order to preserve the legal unity of the Republic and the sovereignty of the constitutional legislator. The article critically analyzes the implications of the reform, identifying the emergence of a new (implicit) substantive limit to constitutional revision which would result in the risk of an indefinite consolidation of regional and provincial prerogatives. Finally, it is argued that the introduction of the principle of agreement (as outlined in the bill under consideration) cannot be considered as necessary even in light of the international obligations arising from the so-called De Gasperi-Gruber Agreement.
